Special Notice for EU Residents-GDPR Privacy Policy

If you are located within the European Union, we acknowledge the rights granted to you under the General Data Protection Regulation (GDPR) to the extent our processing of your data falls within the territorial scope of the GDPR.

This GDPR Privacy Notice outlines the collection, use, storage, transfer, and other processing of personal information provided to us by those located within the European Union (“EU”) in accordance with the GDPR’s territorial scope.   This policy applies exclusively to all processing of your personal data provided to us while you were located in the EU in the context of your application to Hofstra and our recruitment visits to the EU.  The processing of your personal data after your acceptance and enrollment will be subject to governing New York State and United States laws and thus is not subject to this GDPR Privacy Policy.  Hofstra University is the controller of the personal data that is disclosed subject to the GDPR and is the entity responsible for and that controls the processing of your data.

Information Collected

We collect all data in connection with the following circumstances: When you provide us with your personal data in the course of our visits to the EU; when you contact us in connection with your application or our visits to the EU; when you request information from our website, or register for an event; when you submit your application; or when we receive data about you from third party agents used by you to assist in the university search process or by us to assist in the college recruitment process, from third party organizers of university fairs in the EU, or third parties named in your application such as guidance counselors, schools you attended, third party references, or a testing organization for test scores.  We may also collect data about you from publicly available sources.  We will not collect personal data about you from any other third parties.

University Use of Information

We collect and process Information (also referred to as “your data”) pursuant to the following legal justifications under the GDPR: (i) in order to evaluate your application and consider whether to offer you admission to the University, and we may contact you using the contact information you provide to us if we have further questions for you in this regard; (ii) as necessary in the exercise of our legitimate interests, functions and responsibilities as a higher education institution, for example for determining the effectiveness of our recruitment processes or strategies, to improve our services, or as necessary to pursue or defend ourselves against legal claims; and (iii) to comply with legal obligations, such as disclosing your data to third parties as required by law or subpoena or if we reasonably believe such disclosure is necessary to (a) comply with the law and the reasonable requests of law enforcement; and/or (b) to exercise or protect the rights, property, or personal safety of Hofstra, members or our community, or others. 

Your data may be shared by us, pursuant to legitimate University interests and in order to evaluate your application, with third party service providers who have entered into contracts with us to perform functions on behalf of the University such as analytical services, hosting services or recruitment services, subject to the obligations of confidentiality, use of the personally identifying information solely as necessary for delivering the services and safeguarding from unauthorized disclosure. We also use your data to conduct general demographic and statistical research to improve University programs. 

We use personal data (your name, email address and information about your particular interest in Hofstra) that you provide to us through our website or during our visits to the EU to respond to your inquiry and to provide you with information about Hofstra.  You may request that we remove you from email communication by using the opt out link on our emails.

We may use your data in anonymized, aggregated form for statistical reporting purposes to government agencies or in response to surveys.

For purposes of this GDPR Privacy Policy, Information refers to any other information concerning a natural person that is created by or provided to the University from or concerning students or applicants.

Security and Storage

We implement appropriate technical and organizational security measures to protect your information when you transmit it to us and when we store it on our information technology systems.  As we are located in the United States, any data you provide will be processed and stored in the United States and may be processed and stored in other jurisdictions outside the EU.  We take reasonable steps to ensure that your data is treated securely and in accordance with applicable law and this Privacy Policy.  Your data will be stored by us and/or our third party service providers so long as is necessary or required by policy and law.

Your Rights and other Required Disclosures

Under GDPR, you have certain rights with respect to your personal data, including, among other rights, the right of access to your data; the right to correct inaccuracies in your data; the right to withdraw your consent; the right to lodge a complaint; the right to portability of your data; and the right to delete personal data if the collection of that data is no longer necessary to the purpose for which it was collected.  IN SOME CASES YOU HAVE THE RIGHT TO OBJECT TO ANY PROCESSING BASED ON OUR LEGITIMATE INTERESTS WHERE THERE ARE GROUNDS RELATING TO YOUR PARTICULAR SITUATION. FURTHERMORE YOU CAN OBJECT TO MARKETING ACTIVITIES FOR WHATEVER REASON WHATSOEVER AT ANY TIME.

Information created in the European Union may be transferred out of the European Union to the University. If you feel the University has not complied with applicable foreign laws regulating such information, you have the right to file a complaint with the appropriate supervisory authority in the European Union.
